Terms of Service
Effective Date: Date of account creation, payment submission, or first use of PoolFinder, whichever occurs first.
1. Agreement to Terms
These Terms of Service govern your access to and use of PoolFinder, including the PoolFinder website, web application, mobile application, dashboard, data tools, prospecting features, route tools, export features, and related services.
By creating an account, accessing PoolFinder, submitting payment, or using the service, you agree to these Terms of Service. If you do not agree, you may not use PoolFinder.
PoolFinder is operated by Realtor Recon LLC d/b/a PoolFinder, referred to in these Terms as “PoolFinder,” “we,” “us,” or “our.”
2. Service Description
PoolFinder provides a subscription-based dashboard that displays property-related intelligence involving homes for sale, recently sold homes, and properties that may contain pools within user-selected or available ZIP codes, markets, or territories.
PoolFinder is an informational and organizational prospecting tool only. PoolFinder does not provide guaranteed leads, guaranteed customers, guaranteed sales, guaranteed appointments, exclusive opportunities, or guaranteed business outcomes.
Users are solely responsible for deciding how to use the information displayed in PoolFinder and for independently verifying any information before acting on it.
3. Account Registration and Access
To use certain features of PoolFinder, you may be required to create an account and provide accurate account information, including your name, email address, business information, service area, billing information, or other information requested during signup.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You may not share your account access, resell your login, allow unauthorized users to access your dashboard, or use PoolFinder on behalf of another business without our written permission.
We may suspend or terminate access if we believe your account information is inaccurate, your account is being misused, or your use violates these Terms.
4. Subscription, Billing, and Cancellation
PoolFinder is offered as a paid subscription service. Billing begins when payment is submitted or when your paid subscription begins, depending on the checkout or offer presented at the time of signup.
Unless canceled, your subscription renews automatically on a recurring basis according to the billing terms presented at checkout.
You may cancel your subscription at any time through your account, by using available cancellation tools, or by contacting support at support@poolfinder.ai.
Cancellation stops future billing. Unless otherwise stated, cancellation does not automatically entitle you to a refund, credit, or prorated charge. Access may remain active through the end of the current paid billing period.
All payments are final except where required by law or where PoolFinder chooses, in its sole discretion, to issue a refund, credit, or adjustment.
5. App Store, Mobile App, and Third-Party Payment Terms
If PoolFinder is accessed through a mobile application, app wrapper, mobile browser, or third-party platform, your use may also be subject to the terms, rules, or policies of that platform.
If you purchase access through a third-party platform or payment provider, that provider’s billing, cancellation, refund, and payment rules may apply in addition to these Terms.
PoolFinder is not responsible for delays, interruptions, restrictions, or account issues caused by app stores, device platforms, payment processors, browsers, operating systems, or other third-party services.
6. ZIP Code and Territory Access
PoolFinder may display property data based on ZIP codes, territories, markets, service areas, or other geographic filters.
ZIP code and territory availability may change at any time. PoolFinder does not guarantee ZIP code availability, data volume, market coverage, exclusivity, saturation limits, opportunity volume, or continued access to any specific geographic area.
Unless expressly stated in a separate written agreement signed by PoolFinder, no ZIP code, territory, market, or customer opportunity is exclusive.
7. Data Accuracy and Verification
PoolFinder relies on third-party data sources, public records, property listings, automated processes, artificial intelligence, data vendors, scraping tools, APIs, and other external sources.
Data may be delayed, incomplete, inaccurate, duplicated, outdated, unavailable, or incorrectly classified.
PoolFinder does not guarantee:
that a property has a pool;
that a property needs pool service;
that a homeowner is seeking service;
that a property is currently for sale or recently sold;
that ownership information is current;
that contact information is accurate;
that an agent, broker, owner, or other contact is reachable;
that any displayed opportunity will result in a customer, sale, appointment, route addition, or revenue.
You are responsible for independently verifying all information before contacting anyone, visiting a property, making business decisions, or relying on the data.
8. No Guarantees
PoolFinder makes no guarantees regarding leads, lead quality, customer acquisition, revenue, job volume, appointment setting, conversion rates, route growth, return on investment, exclusivity, availability of data, or business outcomes.
Any examples, estimates, sample data, demo content, screenshots, marketing statements, or product explanations are for illustrative purposes only and are not guarantees.
9. Acceptable Use
You may use PoolFinder only for your internal business operations and lawful prospecting, routing, organization, and customer acquisition efforts.
You agree not to:
resell, redistribute, sublicense, publish, or transfer PoolFinder data;
scrape, extract, crawl, copy, or bulk-download PoolFinder data except through approved export tools;
share your login or dashboard access with unauthorized users;
use PoolFinder to harass, threaten, spam, deceive, or unlawfully contact any person;
use PoolFinder in violation of telemarketing, texting, calling, email, privacy, trespassing, consumer protection, or data protection laws;
attempt to reverse engineer, interfere with, overload, bypass, or compromise PoolFinder systems;
use automated tools, bots, scripts, or scraping systems against PoolFinder without written permission;
misrepresent your relationship with PoolFinder;
use PoolFinder data for any unlawful, abusive, or deceptive purpose.
10. User Compliance Responsibilities
You are solely responsible for complying with all laws, rules, and regulations that apply to your business and outreach activities, including laws relating to phone calls, text messages, email, door-to-door solicitation, privacy, consumer protection, trespassing, licensing, advertising, and professional conduct.
PoolFinder provides information and workflow tools. PoolFinder does not provide legal advice, compliance advice, or permission to contact any person in any particular manner.
11. Exports, Downloads, and Data Handling
PoolFinder may allow users to export, download, copy, or save certain data. Export features are provided for convenience and internal business use only.
You are responsible for securing any exported data and using it lawfully. PoolFinder is not responsible for how you store, share, process, contact, or act upon exported data after it leaves the platform.
12. User Content and Uploaded Information
PoolFinder may allow you to save notes, upload photos, add custom leads, create pipeline records, track statuses, or enter other business information.
You retain responsibility for the information you add to PoolFinder. You represent that you have the right to upload, store, and use any information you submit.
You agree not to upload unlawful, abusive, private, confidential, infringing, misleading, or harmful content.
13. Third-Party Services and Dependencies
PoolFinder may rely on third-party services, including hosting providers, databases, payment processors, app platforms, analytics tools, property data providers, public record sources, mapping tools, email tools, and other vendors.
Interruptions, outages, restrictions, inaccuracies, pricing changes, policy changes, or data changes caused by third parties are outside PoolFinder’s control and do not automatically qualify for refunds, credits, or damages.
14. Platform Changes
PoolFinder may modify, add, limit, suspend, discontinue, or remove features, data sources, dashboards, pricing, territories, delivery methods, exports, mobile functionality, or other parts of the service at any time.
PoolFinder may also update or change these Terms at any time. Continued use of PoolFinder after changes are posted or made available constitutes acceptance of the updated Terms.
15. Account Suspension and Termination
PoolFinder may suspend or terminate your account, with or without notice, if we believe that you:
violated these Terms;
failed to pay amounts owed;
misused PoolFinder data;
shared unauthorized access;
attempted to interfere with platform operations;
engaged in abusive, unlawful, deceptive, or disruptive behavior;
created risk for PoolFinder, its users, vendors, partners, or systems.
If access is suspended or terminated for violation of these Terms, you are not entitled to a refund except where required by law.
16. Data Retention
PoolFinder does not guarantee permanent retention of user data, historical data, saved leads, notes, pipeline records, uploaded photos, exports, or account history.
After cancellation, failed payment, suspension, or termination, your access to stored information may be limited or removed. You are responsible for exporting or recording any information you wish to retain before cancellation or termination.
17. Intellectual Property
PoolFinder, including its name, software, dashboard design, workflow, branding, data organization, graphics, logos, text, features, and related materials, is owned by PoolFinder or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from PoolFinder except as expressly allowed by these Terms.
18. Disclaimers
PoolFinder is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, PoolFinder disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted operation.
PoolFinder does not warrant that the service will be error-free, secure, uninterrupted, current, complete, or free from harmful components.
19. Limitation of Liability
To the fullest extent permitted by law, PoolFinder is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost data, service interruptions, or reputational harm.
PoolFinder’s total liability for any claim arising from or related to the service shall not exceed the amount paid by you to PoolFinder during the most recent billing cycle before the event giving rise to the claim.
20. Indemnification
You agree to defend, indemnify, and hold harmless PoolFinder, Realtor Recon LLC, its owners, employees, contractors, vendors, affiliates, and service providers from any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys’ fees, arising from your use of PoolFinder, your outreach activities, your violation of these Terms, your violation of law, or your misuse of data.
21. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
To the fullest extent permitted by law, the exclusive venue for any dispute arising from or related to these Terms or PoolFinder shall be the state or federal courts located in Citrus County, Florida, or the nearest court with proper jurisdiction.
22. Electronic Acceptance
By creating an account, submitting payment, clicking to accept, accessing PoolFinder, or using the service, you agree to these Terms electronically pursuant to the U.S. Electronic Signatures in Global and National Commerce Act and other applicable electronic signature laws.
