PoolFinder Terms of Service Effective Date: Date of initial payment submission 1. Service Description PoolFinder provides a subscription-based dashboard displaying property intelligence related to homes for sale and recently sold homes that may contain pools, within user-selected ZIP codes. PoolFinder is an informational prospecting tool only and does not provide guaranteed leads, sales opportunities, or outcomes. 2. Billing & Cancellation Billing begins immediately upon payment and recurs monthly unless canceled. All payments are final. PoolFinder does not offer refunds, credits, or prorated charges under any circumstances. You may cancel at any time through your account. Cancellation stops future billing; access remains active through the end of the current billing period. 3. ZIP Code Access Users select ZIP codes for which PoolFinder displays data. ZIP availability is subject to change and is provided only while the subscription remains active and in good standing. PoolFinder makes no guarantees regarding ZIP availability, saturation, exclusivity, or opportunity volume. 4. Usage Restrictions You may not resell, scrape, extract, redistribute, sublicense, or share PoolFinder data or dashboard access. Use is limited to your internal business operations only. 5. Accuracy Disclaimer PoolFinder relies on third-party data sources, public records, and automated processes. Data may be delayed, incomplete, inaccurate, or outdated. PoolFinder does not guarantee the presence of pools, service needs, ownership status, property conditions, or contact accuracy. Users are responsible for independent verification before acting on any information. 6. No Guarantees PoolFinder makes no guarantees regarding results, lead quality, revenue, job volume, conversions, or business outcomes. The service is provided solely as an informational and prospecting utility. 7. Third-Party Dependencies PoolFinder relies on external platforms, APIs, and data providers. Interruptions, data changes, outages, or inaccuracies originating from third parties are outside PoolFinder’s control and do not qualify for refunds or credits. 8. Platform Changes PoolFinder may modify features, data sources, dashboards, delivery methods, pricing, or availability at any time without notice. 9. Account Suspension & Abuse PoolFinder may suspend or terminate access without refund if a user violates these terms, engages in abusive or disruptive behavior, attempts to interfere with platform operations, or misuses data. 10. Data Retention PoolFinder does not guarantee retention of historical data after cancellation or termination. Users are responsible for exporting or recording any information they wish to retain prior to account termination. 11. Limitation of Liability PoolFinder’s total liability shall not exceed the amount paid by the user during the most recent billing cycle. PoolFinder is not liable for any indirect, incidental, consequential, special, or punitive damages. 12. Governing Law & Venue This Agreement is governed by the laws of the State of Florida. Citrus County, Florida is the exclusive venue for any dispute arising from or related to this Agreement. 13. Entire Agreement This Agreement constitutes the entire understanding between the parties and supersedes all prior communications or agreements. PoolFinder may update these Terms of Service at any time. Continued use of the service constitutes acceptance of the most current version. 14. Electronic Acceptance By using PoolFinder and submitting payment, you agree to these Terms of Service pursuant to the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
